Waste management records - What does it entail?

Waste management records begin with the identification of waste categories generated by a commercial company, continuing with monthly records, PRODDES reporting in SIM, handing over waste to authorized collectors for transportation, storage, treatment and recycling of waste, with the aim of reducing their harmful effect on health and the environment, as well as valorizing resources by reusing recoverable parts.

The records of waste management must be carried out by persons trained in this regard (Environmental Manager), and in the case of commercial companies whose activity requires authorization from the environmental authorities, it is mandatory by law for the person in charge of waste management to have specialized courses .

Waste management activity is regulated on the territory of Romania by GEO 92/2021 , GD 1061/2008 and GD 856/2002.

Waste Management and Records - Who is it for?

Waste management records are an activity that any commercial company must carry out because its own activity results in waste.

This activity, depending on the industry and the scale of the company, can be a more simplistic activity or a very complex one, but it is certainly a very important one from the perspective of the penalties that a commercial company can pay in case of non-compliance.

A business generating waste is responsible for the entire waste flow, from generation to termination of waste status.

In addition, commercial companies authorized for waste collection have additional responsibilities regarding waste management, namely, specific records and reports, such as:

  • records and reports on the waste area of portable batteries and accumulators (B&A);
  • records and reports on the electrical and electronic equipment waste area;
  • records and reports in the area of used tires
  • records and reports in the area of used oils (mineral and synthetic);
  • specific records and reporting for any other hazardous and non-hazardous waste collected.

Waste management records - frequently asked questions

Is selective collection mandatory for a company that only carries out office activities?

Yes, it is mandatory. There must be a container for each type of waste, labeled with the corresponding waste code: paper-cardboard, plastic, metal, glass, household, any other type of waste. The containers must be labeled with the name and code specific to each type of waste.

What is the difference between packaging and packaging waste?

It is one of the most common confusions among economic agents, namely the confusion between packaging and packaging waste. Any economic agent can generate packaging waste, and has the obligation to collect it selectively and hand it over to an authorized collector. The packaging placed on the market versus the waste generated as a result of the activity carried out by the economic agent give rise to different obligations towards the environmental authorities as follows:

- The introduction of packaging on the national market entails the obligation to quantify and centralize the weight of packaging introduced, to report it to the Environmental Fund Administration (AFM) and to pay to achieve the recycling objectives for it.
- The packaging waste generated as a result of the activity is subject to the regulations imposed by the Ministry of the Environment and the Environmental Protection Agency (EPA), namely their selective collection, delivery to an authorized collector, keeping and reporting of waste management records to the county APM.

What environmental obligations do I have as a manufacturer / importer of packaged products?

Economic operators producers and importers of packaged goods and retail packaging are obliged to calculate and declare monthly, by the 25th of the month following the month in which the activity was carried out, the total amount of packaging introduced on the market, broken down by type of material , respectively: glass, plastic, PET paper/cardboard, metal, aluminum, wood. The contributions provided for in art. 9 para. (1) letter d) of GEO 196/2005, namely 2 lei/kg, are paid only in the event of non-fulfillment of the objectives for the recovery of packaging waste introduced on the national market, for which they have not handed over responsibility to an OIREP.

In the case of a commercial company that purchases packaging from Romania to pack its products (bread, bakery) from its own production, who has the obligation to declare the packaging?

The obligation to pay the tax for the Environmental Fund rests with economic operators who introduce packaged PRODUCTS on the market. As you put the "bread" product on the market, which you pack accordingly, you have the obligation to pay the contribution for the packaging of those products.

For custom bags purchased in Romania, who must declare the quantity of packaging introduced: the manufacturer or the buyer?

The one whose mark is on the bag. If they are not customized, then the manufacturer declares.

Where should we declare the quantities of waste?

For the generated waste, the Waste Management Record is drawn up and submitted in the form of an annual declaration to the county APM.
